Welcome to xavware.com (the “Site”), owned and operated by XAVware LLC (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply only to your use of the public-facing website. They do not govern:

  • Freelance software development, consulting, or professional services
  • Any standalone applications, tools, or software released by XAVware, each of which has its own Terms of Service and Privacy Policy

1. Use of the Site

You may use the Site solely for lawful purposes and in accordance with these Terms. You agree not to:

  • Interfere with the operation or security of the Site
  • Attempt to access restricted systems or data
  • Use automated systems (bots, scrapers, etc.) without permission
  • Upload or transmit malicious code, spam, or harmful content

2. Contact Form

If you submit a message through the Site’s contact form, you agree to provide accurate information and not use the form for:

  • Harassment
  • Spam
  • Unauthorized commercial solicitation
  • Transmission of harmful or illegal material

Submitting a message does not create a client relationship.


3. Stripe Tips (Payments)

The Site allows users to optionally send tips using Stripe’s Embedded Checkout.

  • Tips are voluntary and are not payments for services.
  • Tips are nonrefundable, except where required by law.
  • All payment processing is handled solely by Stripe; we do not collect or store any financial information.

By submitting a tip, you authorize Stripe to process the charge in accordance with its terms and policies.


4. Intellectual Property

Unless otherwise noted, all content on the Site—including text, graphics, branding, animations, design elements, and code—is the property of XAVware LLC.

You may not copy, modify, reproduce, or distribute Site materials without written permission, except where permitted by law (e.g., fair use).

This section does not apply to software projects or repositories that XAVware releases separately under their own licenses or terms.


5. Third-Party Services

The Site may integrate third-party services such as:

  • Stripe (payment processing)
  • Resend (email delivery)

These services have their own terms and privacy practices. By using any features that rely on these providers, you also agree to their respective policies.

We are not responsible for third-party actions or content.


6. Disclaimer of Warranties

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not guarantee that:

  • The Site will be uninterrupted or error-free
  • The content will be free of viruses or harmful components
  • The information on the Site will always be accurate or complete

You use the Site at your own discretion and risk.


7. Limitation of Liability

To the fullest extent permitted by law, XAVware LLC is not liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, revenue, or goodwill
  • Any damages arising from your use or inability to use the Site

Our total liability for any claim related to the Site will not exceed the amount you have paid to us through the Site, if any (including tips).


8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.


9. Jurisdiction and Venue

You irrevocably and unconditionally agree that:

  • All disputes, claims, or controversies arising out of or relating to your use of the Site shall be brought solely and exclusively in the courts of the State of New Jersey, sitting in Sussex County (“NJ Courts”).
  • You waive any objection to venue in the NJ Courts, including claims of inconvenient forum.
  • You agree not to assert that any litigation filed in the NJ Courts has been brought in an improper venue.

10. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the most recent revision.

Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
